End User License Agreement

Last updated

This End User License Agreement (“Agreement”) is between you and Kunal Sahu, an individual based in India (“we”, “us”) for the MD Reader desktop application for Windows, including updates we provide (the “Software”). By installing or using the Software you accept this Agreement. If you don't accept it, don't install the Software, and ask for a refund under our Refund Policy.

1. License grant

When you buy a license, we grant you a perpetual, non-exclusive, non-transferable license to install and use the Software:

  • for personal and commercial purposes, including at work and on client projects;
  • by one person (the license holder), on up to three Windows devices that person uses.

Organisations need one license per person who uses the Software. The license is a one-time purchase: there are no recurring fees.

2. Updates

Your license includes all updates within the same major version (for example, every 1.x release). We may offer future major versions as a paid upgrade; the version you bought keeps working.

3. Restrictions

You may not: (a) sell, rent, lease, sublicense or share your license key; (b) distribute the Software or make it available to others over a network; (c) remove or bypass license checks; or (d) reverse-engineer, decompile or disassemble the Software, except to the extent the law expressly allows it despite this restriction.

4. Your files

The Software opens and renders files on your device and doesn't upload them. You keep all rights to your content.

5. Third-party components

The Software includes open-source components (such as Mermaid) under their own licenses, listed in the app's About screen, and uses the Microsoft Edge WebView2 Runtime, which is subject to Microsoft's terms. Those licenses govern those components.

6. Microsoft Store purchases

If you got the Software from the Microsoft Store, the Store's usage rules for how many devices you can install it on also apply. If they conflict with section 1, the more generous rule applies to you.

7. Ownership

The Software is licensed, not sold. We keep all intellectual-property rights in it, except for the open-source components owned by others.

8. Termination

This license ends automatically if you materially break this Agreement or if you receive a refund. When it ends you must stop using and uninstall the Software.

9. Warranty disclaimer

Apart from the refund rights in our Refund Policy and any rights consumer law gives you that can't be excluded, the Software is provided “as is”, without warranties of any kind, including fitness for a particular purpose. We don't guarantee it will be error-free or that it will render every Markdown or Mermaid file exactly as other tools do.

10. Limitation of liability

To the fullest extent permitted by law, our total liability under this Agreement is limited to the amount you paid for the Software, and we're not liable for indirect, incidental or consequential damages, including loss of data or profits.

11. Export and law

You agree to follow the export laws that apply to you. This Agreement is governed by the laws of India, and courts in India have jurisdiction, without affecting the mandatory consumer protections of the country where you live.
